Welcome to Domi Skin.

Domi Skin is an unincorporated sole proprietorship operating in Ontario, Canada. In these Terms of Service, “Domi Skin,” “we,” “us” and “our” refer to the sole proprietorship carrying on business as Domi Skin.

Domi Skin operates this website and online store, including the information, content, features, products and services made available through it (collectively, the “Services”). Our online store is powered by Shopify.

These Terms of Service (“Terms”), together with our Refund & Return Policy, Privacy Policy, Shipping Policy and any other policies expressly incorporated by reference, govern your access to and use of the Services and purchases made through our store.

Please read these Terms carefully before using our website or placing an order.

By accessing or using our Services, or by placing an order after these Terms and applicable policies have been made available to you, you agree to these Terms to the extent permitted by applicable law.

If you do not agree with these Terms, you should not use the Services.

Nothing in these Terms excludes, restricts or replaces any right or remedy that cannot lawfully be waived under applicable consumer protection law.

ELIGIBILITY AND ACCOUNT INFORMATION

You must be at least the age of majority in your province, state or other jurisdiction of residence to enter into a purchase contract with us, or otherwise have the authorization of a parent or legal guardian where permitted by law.

When you place an order or create an account, you agree to provide accurate, current and complete information, including your name, email address, billing information and shipping information.

You are responsible for reviewing your information for accuracy before submitting an order and for maintaining the confidentiality of any account credentials associated with the Services.

You may not use the Services for an unlawful or unauthorized purpose.

PRODUCTS

We make reasonable efforts to describe and display our products accurately.

Product packaging, colour, appearance and other visual characteristics may appear differently depending on your device, screen settings, lighting, packaging updates or manufacturing variations.

Ingredient lists, product packaging and product information may occasionally be updated. You should review the ingredient list and directions appearing on the product you receive before use, particularly if you have allergies, sensitivities or specific ingredient concerns.

Nothing in this section permits Domi Skin to provide goods that are materially different from their description or otherwise removes rights available to you under applicable law.

We may modify, discontinue or limit the availability of products, quantities or product variations at any time, subject to existing accepted orders and applicable law.

SKINCARE INFORMATION AND PRODUCT USE

Information on our website concerning skincare, ingredients, routines, product benefits and cosmetic concerns is provided for general informational purposes and is not medical advice.

Unless expressly stated in connection with a product that has the required legal authorization, Domi Skin cosmetic products and website content are not intended to diagnose, treat, cure or prevent disease.

Individual experiences with cosmetic products vary. A product’s suitability may depend on a person’s skin type, allergies, sensitivities, other products being used and other individual circumstances.

Please follow the directions and warnings provided with each product. Consider patch testing a new skincare product before broader use where appropriate.

Discontinue use if irritation or an adverse reaction occurs. Seek appropriate medical attention if you experience a serious or concerning reaction.

Nothing in this section limits Domi Skin’s responsibility for a defective, unsafe, contaminated, incorrectly labelled or otherwise legally non-conforming product, or any right or remedy available to you under applicable law.

ORDERS AND CONTRACT FORMATION

When you submit an order, you are offering to purchase the products in your order at the prices and on the terms presented to you during checkout.

Please review your cart, shipping address, billing information, products, quantities and other order information carefully before submitting your order.

An automated acknowledgement that we have received your order does not necessarily mean that we have accepted the order.

We may decline or cancel an order before shipment where reasonably necessary, including because of product unavailability, suspected fraud, payment problems, pricing or listing errors, shipping restrictions, quantity limitations or other legitimate business reasons.

If we cancel an order after payment has been collected and no goods will be supplied, we will refund the amount collected for the cancelled portion of the order in accordance with applicable law.

We may contact you using the email address or telephone number supplied with your order if additional information is needed.

Products purchased through our retail store are intended for personal or household use unless we expressly agree otherwise. You may not purchase products for unauthorized commercial resale.

PRICES, TAXES AND OTHER CHARGES

Prices are displayed in the currency indicated on the website or at checkout.

The price applicable to your order will be the price shown when you submit the order, subject to the correction of genuine errors as permitted by applicable law.

Applicable taxes, shipping charges and other charges collected by Domi Skin will be disclosed before you complete your purchase.

For international shipments, customs duties, import taxes, brokerage charges or similar government or carrier charges may apply. Where such amounts are not collected by Domi Skin and are the responsibility of the recipient, we will disclose this where reasonably required and practicable.

We will not intentionally advertise an unattainable price by adding undisclosed mandatory fixed fees controlled by Domi Skin at the end of the purchase process.

Promotional offers, discount codes and special pricing may be subject to separate terms. Unless expressly stated otherwise, promotions cannot be combined.

PAYMENT

You agree to provide current, complete and accurate payment and billing information.

By submitting payment information, you represent that you are authorized to use the payment method provided and authorize the applicable charges associated with your order.

Payments are processed through Shopify and/or third-party payment providers. We do not control all aspects of third-party payment processing.

SHIPPING AND DELIVERY

Available shipping destinations, shipping charges and estimated delivery information are displayed through our store and/or Shipping Policy.

Processing, shipment and delivery estimates are estimates unless we expressly identify a date as guaranteed.

We will make reasonable efforts to ship orders within the timeframe represented to you.

Carrier delays, customs delays, weather events and circumstances outside our reasonable control may affect delivery. However, nothing in these Terms eliminates any cancellation, notice, refund, delivery or other obligation imposed on Domi Skin by applicable law.

For orders subject to United States federal shipping rules, if we cannot ship within the time represented to you, or within an otherwise applicable legal period, we will provide any delay notice, cancellation option or refund required by applicable law.

If an order appears to be lost or damaged in transit, please contact support@domiskin.com so that we can investigate and provide any remedy required by our policies or applicable law.

Any allocation of title or risk of loss will be determined in accordance with applicable law. Nothing in these Terms transfers to you a risk that applicable law requires Domi Skin to bear.

RETURNS, REFUNDS AND ORDER PROBLEMS

Returns and refunds are governed by our Refund & Return Policy.

Our voluntary return policy generally permits eligible unopened and unused products to be returned when a return is requested within 30 days after delivery, subject to the conditions described in that policy.

Opened, used or unsealed skincare products are generally not eligible for a voluntary change-of-mind return for hygiene and safety reasons.

These restrictions do not eliminate rights relating to defective, damaged, contaminated, misdescribed, incorrect or otherwise legally non-conforming goods.

If there is any conflict between a voluntary limitation in our Refund & Return Policy and a non-waivable right provided by applicable law, the applicable law will prevail.

INTELLECTUAL PROPERTY

The Services and their original content, including text, product photography, graphics, logos, trademarks, design elements, videos and other materials owned by Domi Skin are protected by applicable intellectual property laws.

Subject to applicable law, you may use the Services only for your personal, non-commercial use.

You may not reproduce, copy, distribute, sell, commercially exploit, modify, publicly display or create derivative works from our protected content without permission, except where applicable law permits such use.

“Domi Skin,” our logos and our product branding may constitute trademarks or other protected indicia of source. Nothing in these Terms grants you ownership of or a license to use them for commercial purposes.

THIRD-PARTY SERVICES AND LINKS

Our Services may contain links to, integrations with or functionality supplied by third parties.

Third-party services may be governed by their own terms and privacy practices.

We are not responsible for independent third-party websites or services that are outside our reasonable control, except to the extent applicable law provides otherwise.

RELATIONSHIP WITH SHOPIFY

Our online store is powered by Shopify, which provides technology that enables us to operate the Services.

Products sold through the Domi Skin store are sold by Domi Skin, not by Shopify.

Nothing in this section limits any rights you may have against Domi Skin or Shopify that cannot lawfully be waived.

PRIVACY

Our collection, use and disclosure of personal information are addressed in our Privacy Policy.

Because our online store is hosted by Shopify, Shopify and other service providers may process personal information in connection with operation of the store, checkout, payments, fraud prevention, analytics and other functions as described in the applicable privacy disclosures.

Please review our Privacy Policy before submitting personal information through the Services.

REVIEWS, FEEDBACK AND USER CONTENT

If you voluntarily submit a product review, photograph, testimonial, suggestion or other content to Domi Skin, you represent that you have the right to submit that content and that it does not unlawfully infringe the rights of another person.

Unless otherwise agreed, you grant Domi Skin a non-exclusive, worldwide, royalty-free license to reproduce, display and use content you intentionally submit for publication in connection with operating, marketing and improving Domi Skin and its Services.

We will not knowingly alter a customer review in a manner that materially misrepresents the reviewer’s opinion.

You must disclose any compensation, free product or other material incentive received in connection with a review where disclosure is required by law.

We may remove content that is unlawful, fraudulent, abusive, infringing, misleading or otherwise violates these Terms.

PROHIBITED USES

You may not use our Services:

for an unlawful or fraudulent purpose;
to violate applicable laws or the rights of another person;
to infringe intellectual property rights;
to introduce malicious software or interfere with the security or operation of the Services;
to impersonate another person;
to submit knowingly false payment, identity or shipping information;
to scrape or commercially exploit the Services in a manner prohibited by law or these Terms; or
to engage in conduct that materially interferes with another person's lawful use of the Services.

We may restrict or terminate access where we reasonably believe these Terms have been materially violated, subject to applicable law.

ERRORS AND AVAILABILITY

Occasionally, information on our website may contain typographical errors, inaccuracies or omissions concerning product descriptions, availability, pricing, promotions, shipping charges or other information.

We may correct genuine errors and update website information.

If a material error affects an order you have already submitted, we will address the order in accordance with applicable consumer law and will not use this provision to avoid an otherwise binding consumer right.

WEBSITE DISCLAIMER AND STATUTORY WARRANTIES

We do not guarantee that our website, online account features or other digital Services will always operate without interruption, delay, security issue or technical error.

To the fullest extent permitted by law, general website information and non-product digital functionality are provided on an “as available” basis.

THIS SECTION DOES NOT DISCLAIM OR LIMIT ANY STATUTORY CONDITION, WARRANTY, GUARANTEE, PRODUCT-SAFETY OBLIGATION OR OTHER CONSUMER RIGHT THAT CANNOT LAWFULLY BE EXCLUDED OR LIMITED.

In particular, nothing in these Terms is intended to negate or vary implied conditions or warranties applying to consumer goods under applicable law.

LIMITATION OF LIABILITY

To the fullest extent permitted by applicable law, Domi Skin will not be liable for indirect, incidental, special, exemplary or consequential losses arising solely from your use of the website where such losses were not reasonably foreseeable and where liability may lawfully be limited.

Nothing in these Terms excludes or limits liability to the extent that applicable law does not permit that liability to be excluded or limited.

Without limiting the previous sentence, these Terms do not exclude or restrict liability for fraud or intentional misconduct, or any non-waivable liability or remedy relating to defective or unsafe products, personal injury, statutory consumer rights or another matter for which applicable law prohibits exclusion or limitation.

INDEMNIFICATION

To the extent permitted by law, you agree to indemnify Domi Skin against third-party claims, losses or reasonable costs directly arising from your unlawful commercial misuse of the Services, your intentional infringement of another person's rights through content you submit, or your material breach of these Terms.

This provision does not require a consumer to indemnify Domi Skin for Domi Skin’s own negligence, unlawful conduct, defective products or breach of a non-waivable legal obligation.

TERMINATION

We may suspend or terminate access to portions of the Services if you materially violate these Terms, engage in fraudulent or unlawful activity, interfere with security or misuse the Services.

Termination does not affect rights or obligations arising from purchases already completed except as applicable law or these Terms otherwise provide.

GOVERNING LAW AND CONSUMER RIGHTS

These Terms and any dispute arising from them or your purchase from Domi Skin are governed by the laws of the Province of Ontario and the federal laws of Canada applicable in Ontario, without regard to conflict-of-laws principles.

Subject to applicable consumer protection law, the courts of Ontario, Canada will have non-exclusive jurisdiction over disputes relating to these Terms or the Services.

Nothing in these Terms deprives a consumer of any mandatory right, remedy, protection, statutory warranty, limitation period, jurisdictional right or ability to bring a proceeding in another forum that applicable law does not permit the consumer to waive.

Where the mandatory consumer protection law applicable to you provides greater protection than these Terms, that mandatory law will apply to the extent of the inconsistency.

CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to our business, Services, policies or legal obligations.

The date shown at the top identifies the latest version.

Material changes will be communicated where required by applicable law.

Unless applicable law provides otherwise, changes will operate prospectively and will not retroactively remove rights relating to an order entered into under an earlier version of these Terms.

SEVERABILITY

If any portion of these Terms is found to be unlawful, invalid or unenforceable, that portion will be interpreted or severed to the minimum extent necessary, and the remaining provisions will continue in effect to the extent permitted by law.

NO WAIVER

Our failure to enforce a provision on one occasion does not constitute a waiver of that provision or of our right to enforce it later.

ENTIRE AGREEMENT

These Terms, together with the policies expressly incorporated into them and the material terms presented to you in connection with your purchase, constitute the agreement between you and Domi Skin concerning the Services and your purchase, subject to any rights or representations that applicable law does not permit us to exclude.
